Terms of Service
Template — review before launch; not legal advice.
Last updated: [DATE]
These terms cover your use of Candlefold (“we”, “us”, “our”), a website that helps a family create a printable funeral program, a memorial slideshow video and prayer/memorial cards. Candlefold is a working name for a business run by [LEGAL NAME], a sole proprietorship based in [STATE], with a mailing address at [MAILING ADDRESS]. By using the site or paying, you agree to these terms.
What you get
- For a one-time payment of $39 (US dollars), you can create and download:
- a print-ready funeral program PDF,
- a memorial slideshow video (MP4), and
- prayer or memorial cards (PDF).
- There is no subscription and no account. You don’t sign up — your project is saved in your own browser.
- Building and previewing your project is free. You only pay when you’re ready to download without the preview watermark.
- Your unlock is valid for 12 months on the device you paid from. Your project itself is saved only in that browser on that device, so save the PDFs and video you download to your phone, Google Drive or iCloud to keep them.
Where we sell
Candlefold is currently available to customers in the United States and Canada, with the exception of Quebec. We hope to serve Quebec in the future; see our contact page if you have questions. We may add or remove regions at any time.
Your photos, your device
The tool that creates your program, slideshow and cards runs in your web browser. In the current version of Candlefold, the photos you add are processed on your device and are not uploaded to us. See our privacy policy for the full picture, including what happens if we ever add a feature that lets other family members send you photos.
Your content, and your word that you have the right to use it
You may add your own photos, text, and music or audio to your project. By uploading or entering anything into Candlefold, you confirm that:
- you own it, or you have the right and any permission needed to use it in this way (including permission from anyone who appears in a photo, where that’s appropriate to get);
- if you upload music or another audio file, you have the right to use that specific recording for a personal memorial program, printed keepsake, or private/family video — including on a livestream or social media, if that’s where you plan to use it; and
- you won’t upload anything that infringes someone else’s copyright, trademark, or other rights, or that is unlawful, defamatory, or violates someone’s privacy.
Music warning: if you upload a commercially released song, streaming platforms like YouTube and Facebook Live may mute or interrupt a livestream that uses it, even though the family is only using it for a private memorial. That’s a decision by the platform, not by us, and we can’t prevent or predict it. Public-domain readings and any music we provide in the tool are chosen with this in mind, but we can’t make the same promise about a song you supply yourself.
You agree to indemnify and hold us harmless from any claim arising from content you upload that turns out not to be yours to use. If we receive a valid copyright takedown notice about something you uploaded, we will respond under the DMCA process below, which may include removing or disabling access to that content.
Copyright complaints (DMCA)
If you believe something on Candlefold infringes your copyright, send a notice that meets the requirements of the Digital Millennium Copyright Act to our designated agent:
[DMCA AGENT NAME] [DMCA AGENT MAILING ADDRESS] [DMCA AGENT EMAIL] Registered with the U.S. Copyright Office, registration number [REGISTRATION NUMBER]
We will respond to valid notices as the law requires.
The AI obituary helper is optional, and it can make mistakes
If you use the optional obituary-writing helper, the facts you type (never your photos) are sent to our AI provider to draft text for you, as described in our privacy policy. The draft is a starting point, not a finished obituary:
- it is only as accurate as the facts you give it, and it does not check anything against outside sources;
- it may leave placeholders for details you didn’t provide; and
- you are responsible for reading the draft carefully and correcting it before you print or publish anything.
No guarantee of print quality, platform behavior, or a venue’s requirements
We help you create files that are ready to print or share. We cannot guarantee:
- how a specific print shop, copy center, or home printer will handle your file (paper stock, color calibration, and duplex settings vary);
- how a funeral home, church, or venue will want the program formatted, or that they will accept a file created outside their own system; or
- how a livestreaming platform, social network, or video-sharing site will handle your slideshow or its audio (see the music warning above).
We give you print instructions and low-resolution warnings to help, but the final result depends on hardware and services we don’t control. If something doesn’t come out the way you expected, please see our refund policy — we’d rather make it right than have you stuck with something that doesn’t work.
Payment
Payments are processed by Stripe. We never see or store your full card number. Prices include any taxes we are required to collect, shown at checkout.
Disclaimer of warranties
The service is provided “as is” and “as available.” We don’t guarantee it will be uninterrupted, error-free, or fit for a particular purpose, beyond what the law requires. Nothing here overrides consumer-protection rights you have under the law of your state, province, or country that can’t be waived by agreement.
Limitation of liability
To the fullest extent the law allows, our total liability for any claim arising out of or relating to Candlefold or your purchase is limited to the amount you paid us for the order in question. We are not liable for indirect, incidental, or consequential damages, including a missed printing deadline, a livestream interruption, or a dispute with a venue or print shop about how a file was handled. This limitation does not apply to the extent it’s not allowed by the law that governs your purchase.
Changes to these terms
We may update these terms from time to time. The date at the top shows the latest version. If we make a material change, we’ll update that date and, where practical, let you know.
Governing law and disputes
These terms are governed by the laws of [STATE], without regard to its conflict-of-law rules, except where your local consumer-protection law requires otherwise.
